As of July 2022, Delta-10, Texas considers Delta-10 legal. The state legislature wrote the Texas House Bill 1325 into law in the 2019-2020 session, legalizing Delta-8, Delta-10, and other hemp-derived cannabinoids.

In the case of regular THC, possessing:

  • Less than 2 ounces is considered a misdemeanor with a $2000 fine and 180-day sentence.
  • Up to 4 ounces can result in a $4000 fine and a one-year prison sentence.
  • Up to 5 pounds is a felony, with a $10,000 fine and 180 days-2 years in prison.
  • Up to 50 pounds will lead to a $10,000 fine and up to 10 years in prison.
  • Up to 2000 pounds is a felony with a mandatory minimum sentence of five years and a maximum of 99 years. The fine is $50,000.

While these are severe enough, if found in possession of the mentioned THC amounts and charged with trafficking or sale of the same, the consequences will be dire.
