The Farm Bill only defines Delta 9 THC and none other. THC is Delta-9. However, in technical terms, the bill does not include Delta-10 THC. Also, it does not define the substance as illegal. Hence, if hemp-derived and contains a maximum of 0.3% THC, it should be legal.

Delta-10 THC and the State Law
As of July 2022, Delta-10, Texas considers Delta-10 legal. The state legislature wrote the Texas House Bill 1325 into law in the 2019-2020 session, legalizing Delta-8, Delta-10, and other hemp-derived cannabinoids.
Is Delta-10 THC a Controlled Substance in Texas?
Not unless its concentration in any product exceeds the 0.3% THC cap. If so happens to be the case, it will come under Schedule 1 of the controlled substances act.
Limits of Delta-10 Possession in Texas
No possession limits apply as long as the Delta-10 you possess is hemp-derived and contains less than 0.3% THC.
In the case of regular THC, possessing:
- Less than 2 ounces is considered a misdemeanor with a $2000 fine and 180-day sentence.
- Up to 4 ounces can result in a $4000 fine and a one-year prison sentence.
- Up to 5 pounds is a felony, with a $10,000 fine and 180 days-2 years in prison.
- Up to 50 pounds will lead to a $10,000 fine and up to 10 years in prison.
- Up to 2000 pounds is a felony with a mandatory minimum sentence of five years and a maximum of 99 years. The fine is $50,000.
While these are severe enough, if found in possession of the mentioned THC amounts and charged with trafficking or sale of the same, the consequences will be dire.
