Is Delta-10 Legal in the State of Texas?

We strive to keep you in the loop with the current status of hemp-infused products, such as Delta-10 THC. Frankly, it is hard to state the legality of THC in the USA, let alone Texas. While the federal government considers it legal, individual state laws vary.

Delta-10 lovers in Texas have been inquiring if their favorite cannabinoid is legal. We can tell you two things. You may already know that cannabis-derived THC is illegal. But is it the same as that occurring in hemp?

Yes, it is legal on a federal level in Texas. However, it must meet specific criteria. It must contain no more than 0.3% THC concentration by dry weight. Additionally, there have been no legal restrictions so far on the rights of citizens to buy, sell, or possess Delta-10.

What is Delta-10 THC?

Delta-10 tetrahydrocannabinol (THC) is a naturally occurring cannabinoid. It is an isomer of its predecessor Delta-9 THC. Both cannabinoids have similar properties and structures, but the D10 variant is less potent.

It occurs in small concentrations in hemp plants. Few plants contain detectable levels of D10. So, much of the Delta-10 infused in commercial products is lab-made and available as high-strength distillate.

It is a preferred cannabinoid for those seeking pleasure and therapeutic benefits. It produces euphoric effects and has been used as a recreational substance since its advent. Some use it for pain and stress relief, mood enhancement, and sleep quality boosters.

Delta-10 THC on the Federal Level

As we said, Delta 10 THC is federally legal. According to the 2018 Farm Bill, any hemp-derived cannabinoid containing less than 0.3% THC is legal. But some nuances apply.

The Farm Bill only defines Delta 9 THC and none other. THC is Delta-9. However, in technical terms, the bill does not include Delta-10 THC. Also, it does not define the substance as illegal. Hence, if hemp-derived and contains a maximum of 0.3% THC, it should be legal.

Delta-10 THC and the State Law

As of July 2022, Delta-10, Texas considers Delta-10 legal. The state legislature wrote the Texas House Bill 1325 into law in the 2019-2020 session, legalizing Delta-8, Delta-10, and other hemp-derived cannabinoids.
